  1. Title to the merchandise of any sales transaction does not pass from our company to purchaser until merchandise is paid in full.

  2. We reserve the right to cancel any sales transaction at any time by notifying the purchaser in writing and returning any monies received on account against the sales transaction.

  3. We will not be liable for delays or failure to ship due to war, strikes, floods, accidents, government demands or priorities, labor disturbances, shortages of supplies or materials or other conditions beyond our control or the manufacturer's. Cancellation by the customer of this sales contract will result in the forfeiture of the required deposit. NO CASH REFUNDS ARE AVAILABLE.

  4. At the time your order is placed, we will request the expected delivery time from the manufacturer and pass this information on to you. From time to time, manufacturers do encounter delays in manufacturing special order furniture. has no control over or liability for delays in delivery by the manufacturer. You agree in advance that your order is not cancellable even if delayed.

  5. It is your responsibility to check your order for accuracy especially with regard to style numbers, finish, and fabric choices. Errors in pricing or arithmetic are subject to correction.

  6. All orders must be paid in full by personal check within 7 business days of email notification to customer that their merchandise is ready for shipment to customer. If customer is not able to receive their furniture when the order is ready to ship, we may store the merchandise at our discretion at an additional cost of 3% of the invoice per month.

  7. If customer does not remit final payment for merchandise ordered within 14 days of notification that the merchandise is ready to ship, or if the check for final payment is dishonored, the order will be cancelled, and all deposits paid will be forfeited as a restocking fee.

  8. Shipment by freight carriers are sent freight collect and DO include standard in-home delivery and set up. Sales orders that are delivered or shipped by freight carriers must be paid in full by personal check before the order will be released. Credit card is not accepted of balance payment. A $30 fee will be charged on all dishonored checks.

  9. Shipping rates are those prevailing at time of shipment and are subject to change without notice. Shipping times cannot be guaranteed, however, will ship all freight on fastest available carrier. reserves the right to split your order into multiple shipments if we determine in our sole discretion that splitting the shipment is appropriate.

  10. is not responsible for fit and/or entry of furniture in your home. Please use the links provided on our website to access the manufacturer's online catalog and determine all dimensions, measurements, and other relevant information before ordering any product through our service. Please measure all stairwells, entrances, and other points through which your furniture must be carried in order to be placed in its intended destination.

  11. Neither the carrier nor is responsible for any damage caused by the freight carrier in delivering furniture through tight spaces, narrow doorways, etc. If setup to the area designated by customer is not conveniently feasible, delivery will be made to an accessible area. Please clear the designated room and the path leading to it of any obstacles in advance of the delivery date.

  12. Delivery personnel are not able to install electronics devices, hang items on walls, or move existing furniture.

  13. is not liable for the accuracy of orders placed by customer. It is the customer's responsibility to ensure the accuracy of all item numbers, finish colors, fabric identifiers, and other product information specified by customer when the order is placed. is not responsible for any errors by customer in correctly specifying the furniture they order through our service.

  14. is not able to provide additional services such as fabric samples, wood finish samples, design assistance, or a furniture showroom. If a more comprehensive purchasing experience is desired, please consider joining one of Kimberly's factory outlet shopping tours, during which you may visit factory outlets, showrooms, and factories and directly inspect all items with professional design assistance before purchasing.

  15. In the event of damage, please be aware of the following when handling a freight claim. All merchandise received should be inspected for damage, such as crushed corners, scratches, dents, punctures or water marks. If any damage is present, please note the nature of the damage on all copies of the delivery documents and have the driver sign them. Retain a copy for your records. The carrier may request that you keep the merchandise and they will authorize a local furniture craftsman to restore to manufacturer specifications. Merchandise returned will be restored or replaced to manufacturer specifications. If uncertain, have the driver call the terminal for instructions. Damage noticed after the driver has left, please contact the carrier within 24 hours. The same applies for manufacturer defects.

  16. All new furniture may have small amounts of pumice dust, wax, glue, superficial scratches and possible packing marks from the wrapping materials or blankets. Pine knots, cherry pits, color and variations in wood grains and scarring in leather are natural characteristics and are not defects, but rather hallmarks of quality furniture. It is impossible to control the expanding and contracting of woods caused by many different humidity conditions throughout the country. nor the carrier are responsible for drawer swelling, door adjustments, touch up or leveling of items.

  17. does not guarantee the durability, wearing quality, and fastness of color of fabrics, vinyl's, or leather products, however, they will be covered under the manufacturer's warranty if warranty is available.

  18. If registered to do so with the state of delivery, will collect sales tax, which will be paid to the applicable state when is paid in full.  If does not collect sales tax, you may have a sales and use tax liability to the state of delivery. It is the customer's responsibility to determine whether they owe any sales tax directly to the state of delivery and pay it directly to the state in a timely manner.

  19. Floor samples, outlet merchandise, and discontinued items are sold as is and are not covered under warranty.

To place an order with

  1. We require a 50% deposit based on the total furniture price. We gladly accept Visa, MasterCard, or personal check for deposits. An order will be placed once has received the deposit.

  2. All furniture ordered through is special order and not cancellable or returnable for any reason.

  3. When your order is ready to be shipped, you will be notified by email. Your order must be paid in full within 7 business days. Credit cards are not accepted for final payments, only personal checks. When your final payment has cleared, your order will be released for shipment to you freight collect, FOB shipper.

  4. Shipping is paid directly to the carrier at time of delivery. Shipping estimates are based on actual weight and final destination. Estimates for delivery charges are based on current rates at time of deposit and placement of order. Any additional fees charged by the carrier at the time of delivery such as small truck rental, ferry fees, gate fees, after-hours fees, missed delivery fees, or oversized merchandise fees, shall be the responsibility of the customer.
